I need to sell my home less than a year after buying it. Will CRA treat me as a flipper?

Possibly, yes. Canada’s Residential Property Flipping Rule applies when you sell a housing unit or an assignment of a purchase contract within 365 days of acquiring it. In most cases, your profit is then treated as fully taxable business income, not a capital gain, and you cannot claim the principal residence exemption. There are exceptions for certain major life events, such as death of you or a related person, marriage breakdown, serious illness or disability, job loss or mandatory job relocation, or threat to personal safety. If your sale clearly fits one of those exceptions, normal capital gains tax rules may still apply, and you may be able to use the principal residence exemption. If you bought, renovated, and sold quickly by choice, CRA is more likely to treat the gain as fully taxable business income.

I’ve been renting out my basement or doing Airbnb. Do I lose my principal residence exemption?

Accepted Answer

Not automatically. If you are renting a small part of your home and still living in most of it, and you have not claimed depreciation or capital cost allowance, you can often still get the full principal residence exemption. You are more likely to lose part of it if a large portion of the home is used for rental, you built a fully separate unit, or you claimed capital cost allowance. Rentals do not cancel the exemption by default, but they do make the tax calculation more complicated.

I inherited my parents’ home. Do I pay tax on everything since they bought it?

No. When someone dies, any gain up to their date of death is usually handled on their final tax return, not yours. When you inherit the home, your cost for tax purposes is generally its value at the date of death. Selling before you leave is usually simpler and avoids large withholdings if the home clearly qualifies as your principal residence, but the best timing depends on your move, the market, and your overall tax situation.

Many sellers assume they do not need to report the sale of their home if there is no tax owing. However, even when your sale is tax-free, the CRA still requires you to report it in order to properly claim the Principal Residence Exemption. To make your filing stronger, keep thorough records of your property’s history, including the purchase agreement, statement of adjustments, land transfer tax, and invoices for major renovations or repairs. These documents, along with records of real estate commissions and legal fees, help establish your adjusted cost base and can reduce any potential taxable gain. Keep these files for at least six years after the year you sell.
