  1. ELIGIBILITY. Open to legal residents of Canada, excluding Quebec, who are twenty-one (21) years of age or older at time of entry. Residents of Quebec are not eligible to enter the Sweepstakes. You must be an individual to win. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate. You are not eligible to enter or win if you are an officer, director, employee, agent, including real estate agent, or representative of RE/MAX Promotions, Inc. (“RE/MAX”) (the “Sponsor“) or its affiliated and related companies (including without limitation, its parent, sister and subsidiary companies),  retailers, franchisees, brokers, NBA Properties, Inc. , the Sponsor appointed designer / design firm, advertising and promotional agencies, all other parties in any way involved in the development or administration of this Sweepstakes, including suppliers of materials or services related to the Sweepstakes, as well as their immediate family members (defined as parents, children, siblings and spouses including common law, regardless of where they live) and those with whom they are domiciled (whether or not related). Selected entrants must be confirmed as winners, including correctly answering a skill-testing question and verification of compliance with these Official Rules.
  2. TO ENTER. The Sweepstakes starts at 12:00AM Eastern Standard Time on October 25, 2022 and ends at 11:59PM Eastern Standard Time on November 21, 2022 (the “Sweepstakes Period”).

To enter, during the Sweepstakes Period, visit the Sweepstakes website at www.remax.ca/yesinyourhouse (“Sweepstakes Website”) and complete and submit the online entry form with all the required information (an “Entry”).

Deadlines: All Entries must be received during the Sweepstakes Period. Entries submitted before or after the Sweepstakes Period will not be entered in the random draw. Proof of transmission is not proof of receipt of an Entry by Sponsor. The clock on Sponsor’s servers will determine the Sweepstake Period.

Limit of one (1) Entry per person. Only one (1) Entry per person. Entrant may only use one (1) email address in connection with the Sweepstakes.  Multiple entrants may not use the same email address.

  1. DISQUALIFIED ENTRIES/SENTRANTS. Sponsor reserves the right, at its sole discretion, to disqualify any Entries or individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or the Sweepstakes Website. In the following circumstances Entries will be disqualified:  lost, late, undelivered, invalid, unintelligible, incomplete, misdirected, illegible, or damaged Entries. In the following circumstances, entrants will be disqualified and all of their Entries will be judged void and disqualified: Entries generated by script, macro, robotic, programmed, or other automated means; Entries and/or entrants that do not comply with or satisfy any or all of the conditions set out in these Official Rules including failure to provide Sponsor with proof of identification; Entries submitted by unauthorized, prohibited or illicit means; Entries that contain false information; entrants who use more than one email address or identity to submit Entries; entrants who attempt to obtain or who submit more than the stated number of Entries permitted by the Official Rules; entrants tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or the Sweepstakes Website; entrants acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other entrant, or Sponsor or Sponsor’s representatives and agents; entrants attempting to undermine the legitimate operation of the Sweepstakes, for example, by cheating, hacking, deception, or other unfair playing practices. If Sponsor suspects any of these circumstances, the entrant will be contacted as soon as practicable. Any prize inadvertently awarded to a selected entrant who ought to have been disqualified by these Official Rules will be reclaimed by Sponsor. All Entries become the property of Sponsor upon receipt and none will be returned.
  1. DISPUTE REGARDING IDENTITY OF AN ENTRANT. In the event of a dispute as to the identity of any person who submitted an online Entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The selected entrant may be required to show proof of being the authorized account holder.
  1. SELECTION AND NOTIFICATION. There will be a random draw in Toronto, Ontario on or about November 22, 2022 from all Entries received (the “Draw Date”).

The selected entrants will be notified by email or phone within five (5) business days from the Draw Date at the email address or phone number provided with the entry. Please check your email and spam filters. Three (3) attempts will be made to contact the selected entrant within the five (5) business day period.

  1. ODDS. Odds of winning depend on the total number of Entries received within the Sweepstakes Period.
  1. ENTRANTS’ AGREEMENT TO ABIDE BY RULES AND DECISIONS. By submitting an Entry, entrants agree that they have read, understood and accepted these Official Rules and further agree to abide by them and all decisions of Sponsor, which shall be final and binding in all matters related to the Sweepstakes and the awarding of the Prizes. No correspondence will be entered into except with selected entrants and prize winners.
  1. PRIZES. There are three (3) prizes available to be won.

Grand Prize. The Grand Prize consists of: (a) the design of a sports-themed theatre room by an interior designer in the winner’s residence; (b) furnishings and audio-visual equipment (examples include couch, TV and surround sound); and (c) installation services of the audio-visual equipment and superficial services such as painting the room but no construction. The maximum budget of (b) and (c) is $34,000 CDN. Design services provided as stated in (a) to be valued at approximately $14,000 CDN. Total approximate retail value is $48,000 CDN.

The design and installation must be completed at the winner’s residence. If the Grand Prize winner does not wish to claim the prize at his or her residence, then at Sponsor’s sole and absolute discretion, the winner may transfer the Grand Prize to another person to undertake the Grand Prize under the same terms and conditions as though winner was able to use the Grand Prize on his/her own residence.

(a) Design. Sponsor will appoint an interior designer to work with the winner to design a single room in the winner’s home to be an sports-themed theatre room. The interior designer may attend the winner’s home; or the design work may be done remotely from pictures and dimensions of the chosen room, which are to be supplied by the winner. If there are constraints to the room chosen by winner, as determined by the interior designer in his/her sole discretion, another room may need to be chosen. The design will not require any “construction”, as defined by Sponsor and/or the interior designer in their sole discretion, but rather will only include cosmetic changes to the room such as paint on the walls. The winner may be required to sign an agreement with respect to the final design.

(b) Furnishings and Audio-Visual Equipment. Working with the Grand Prize winner, the designer will select and purchase furnishings and audio-visual equipment to fulfill the design and arrange for delivery to the Grand Prize winner’s residence.

(c) Installation. The interior designer will select a contractor to quote the cost and timing of the execution of the design (i.e. the cosmetic changes to the room and the installation of the audio-visual equipment). Prior to any work beginning, the winner and any other owner on title of the residence to be renovated must sign and agree to the terms and conditions as set forth on the selected trades’ contracts, as well as a liability release and consent to publicity in a form determined by Sponsor.

If the actual cost of (b) and (c) exceeds $34,000 CDN, the winner will be responsible for all amounts over the budget. If the cost of (a), (b) and (c) are less than the budgeted amounts, the difference will not be provided to the winner. For greater certainty, the winner will not receive any cash or other payment for the unused portion of the Grand Prize.

Sponsor will not be responsible for any additional costs whatsoever including, without limitation, costs associated with either labour and parts or material required due to any hidden or unforeseen work required during the design and installation project and or to complete the project. In addition, Sponsor will not be responsible for the quality of workmanship and any future costs whatsoever associated with the installation work performed or any related taxes. The design installation project should be scheduled to be completed by no later than December 2023, unless otherwise approved by Sponsor, in its sole discretion.

All arrangements for the Grand Prize are subject to Sponsor’s final approval. In addition, the winner must allow Sponsor’s representative to photograph the room before and after the design installation, or in the alternative, provide Sponsor with a minimum of twelve (12) before and after pictures of the installation of the design (“Installation Photos”), in Sponsor’s sole discretion.

The approximate retail value of the Grand Prize is $48,000 CAD.

Second Prize. Second Prize consists of an NBA swag package (including, but not limited to, a jersey, hat, and t-shirt, to be based on winner’s favorite team, as availability allows).  Approximate retail value: $500 CAD.

Third Prize. Third Prize consists of an NBA swag package (including, but not limited to, a jersey, hat, and t-shirt, to be based on winner’s favorite team, as availability allows).  Approximate retail value: $500 CAD.

Each a “Prize” or collectively “Prizes”.

Prizes or any substitutions must be accepted as awarded without representation, warranty or guaranty of any kind and cannot be replaced if lost or stolen. To the maximum extent permitted by applicable law, Sponsor disclaims all representations, warranties and conditions with respect to the Prizes, prize components, and any substitutions thereof. Prizes are non-transferable, non-assignable, non-exchangeable and not redeemable for cash (where applicable) except for the following. Sponsor reserves the right to substitute a prize or component of a prize for one of equal or greater value in Sponsor’s sole discretion.

Prize winners are responsible for any costs or expenses associated with receiving, using or redeeming a Prize (or substitution thereof), including any applicable taxes, duties or fees.

If Prize winner is unable to receive, use and/or redeem the Prize due to reasons beyond the control of the Sponsor, and in the case of the Grand Prize winner, there is no other person designated to be able to receive the Grand Prize in the winner’s place, no compensation or substitute prize whatsoever will be provided.

Second Prize and Third Prize will be delivered to the respective winners at the addresses provided by them.

In no event will Sponsor be liable, including but not limited to malfunction in the technical operation of the Sweepstakes, for more than the stated number of prizes listed in these Official Rules to be awarded.

LIMIT: One (1) prize per household.

  1. WINNER CONFIRMATION. To be confirmed a winner, each selected entrant must:

(i) respond to a notification within the five (5) day period;

(ii) correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question, which will be administered by phone on a day/time set by Sponsor with selected entrant;

(iii) provide identification in a form suitable to Sponsor as determined in its sole discretion;

(iv) execute and return to Sponsor a Declaration of Compliance with Sweepstakes Rules and a Liability Release / Consent to Publicity (“Release”) and any other documentation Sponsor deems necessary within the time period specified by Sponsor. In the case of the Grand Prize winner, this additional documentation will include contracts with the interior design and contractor, and must additionally be signed by all those on title to the selected entrant’s (or entrant’s immediate family member’ to whom the Grand Prize is transferred) home that will be the subject of the Grand Prize; and

(v) otherwise comply with the Official Rules.

If the selected entrants fails to respond to notification within the five (5) day period, fails to correctly answer the mathematical skill-testing question, fails to provide identification, fails to complete and signed the Release within the specified time, makes any false statement(s) in the Release, fails to comply with the Official Rules, or if the notification is consistently returned as undeliverable or fails to reach a selected entrant for any reason (including, without limitation, “soft” and “hard” email “bounces”) or if a selected entrant fails to respond for any reason to the notification as directed, that selected entrant will be disqualified and an alternate entrant will be contacted and undergo the same confirmation process within five (5) business days of the alternative entrant being contacted. If it is subsequently discovered that the winner failed to adhere to the confirmation process, the winner will be required to promptly return to Sponsor his/her/their Prize or the cash value thereof.

  1. PERSONAL INFORMATION. Sponsor will collect, use, and disclose the personal information you provide with your Entry for the purposes of administering the Sweepstakes and prize fulfillment. By entering the Sweepstakes, you consent to such collection, use, and disclosure of your personal information. You may also be offered the opportunity to receive additional communications from Sponsor about its products, upcoming Sweepstakess and promotions.   1. RELEASE OF LIABILITY. By entering, each entrant releases and holds harmless Sponsor, its affiliated and related companies (including, without limitation, its parent, sister and subsidiary companies), retailers, franchisees, brokers, NBA Properties, Inc., the Sponsor appointed designer / design firm, the independent Sweepstakes organization, advertising and promotional agencies, all other parties in any way involved in the development or administration of this Sweepstakes, including suppliers of materials or services related to the Sweepstakes and all of their respective officers, directors, employees, agents, including real estate agents, representatives, successors and assigns (collectively, the “Releasees”) from any liability of any nature or kind arising out of, or in connection with a prize or any portion thereof or this Sweepstakes, including as set out below in the Limitation of Liability section.
  1. LIMITATIONS OF LIABILITY AND RELEASES. By participating in the Sweepstakes, entrants agree to release and hold harmless the Releasees from and against any and all losses, damages, actions, demands, liabilities or claims of whatever nature or kind arising out of, or in connection with a prize or any portion thereof or this Sweepstakes. Without limiting the foregoing, the Releasees shall not be responsible for: (a) the incorrect or inaccurate capture of Entry information; (b) Entries or entrants disqualified for any of these reasons stated in these Official Rules; (c) any loss, damage, or claims caused by, or in any way related to an awarded prize or the Sweepstakes itself; (d) any incomplete or inaccurate information that is caused by users of the Sweepstakes Website, or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of Entries in the Sweepstakes; (e) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (f) the theft, destruction, loss or unauthorized access to, or alteration of, Entries; (g) any failure of the Sweepstakes Website during the Sweepstakes Period, howsoever caused, including without limitation, any human or technical errors or problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (h) garbled transmissions or miscommunications; (i) any failure of any Entries to be received by Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (j) any person’s failure or inability to access any link to the Sweepstakes Website (k) any damage to a user’s (or any other person’s) computer equipment (software or hardware) occasioned by participation in or downloading of materials related to the Sweepstakes; (l) any errors, omissions, incorrect or inaccurate information in any Sweepstakes-related materials, including, without limitation, printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (m) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SWEEPSTAKES WEBSITE AND/OR THE SWEEPSTAKES (INCLUDING ITS PRIZES), DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE SWEEPSTAKES. IN NO EVENT SHALL THE RELEASEES TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $10. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY, REPRESENTATION OR CONDITION OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.   1. CONSENT TO PUBLICITY. By accepting the Prize, each winner (or the permitted transferee in the case of the Grand Prize) agrees to Sponsor’s use of his/her name, city/province of residence, picture, biographical information, statements, voice and likeness and, in the case of the Grand Prize winner, Installation Photos, defined above, in any advertising and publicity Sponsor may conduct relating to the Sweepstakes in any media or format, whether now known or hereafter developed, including but not limited to the internet, at any time or times in perpetuity, without further compensation or notice.
  1. RIGHT TO VOID / MODIFY / SUSPEND. Sponsor reserves the right to terminate, suspend or modify the Sweepstakes, or amend these Official Rules, in whole or in part, at any time and without individual notice or obligation and for any reason. Without limiting the generality of the foregoing, Sponsor may exercise these rights if in it’s sole opinion, any factor interferes with its proper conduct as contemplated by these Official Rules, including an insufficient number of eligible Entries or if the Sweepstakes, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes. In such cases, Sponsor may, in its sole discretion, void any suspect Entries and: (a) terminate the Sweepstakes or any portion thereof; (b) modify or suspend the Sweepstakes, or any portion thereof, to address the impairment and then resume the Sweepstakes, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award any prize from among the eligible, non-suspect Entries received up to the time of the impairment in accordance with the winner selection criteria described in these Official Rules.
  1. GENERAL CONDITIONS.   The Sweepstakes is subject to all applicable federal, provincial, territorial and municipal laws. Void where prohibited. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors.
  1. NON-WAIVER. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  1. SEVERABILITY. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained therein.
  1. WARNING – CIVIL AND CRIMINAL REMEDIES: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE SWEEPSTAKES.
  1. GOVERNING LAW. Any dispute concerning the Sweepstakes, or the rights and obligations of an entrant in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein and adjudicated in the appropriate court in Toronto, Ontario.
  1. RULES GOVERN. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Sweepstakes-related materials, including, but not limited to, any print, online, television, radio or other form of advertising the terms and conditions of these Official Rules shall prevail, govern and control.
